We understand that Youcare about how such information is used, stored and shared. Please read the below to learn more about the same.

  • INTRODUCTION

GrowAyu is the sole author and publisher of the Internet resource www.growayu.com and the mobile application “GrowAyu”(either together or separately for short, the “Website”). GrowAyu owns and operates the services provided through the Website and mobile application, which operates under the brand name “GrowAyu.”
The terms such as “You,”“Your”and “Yours” generally refer to You as the User (as defined under Clause 1.6 of GTC-V.1.01.08) and the terms such as “GrowAyu,” “We,”“Us,”“Company” and “Our”generally refer to GrowAyu.
The terms, “Registered Healthcare Seeker,”“Healthcare Provider” or “HCP,”“Non-Registered User,”“Registered User,” Registered Practitioner” and “User” have the same meaning as are defined respectively under Clause 1 of GTC-V.1.01.08.
GrowAyuis committed to respect the privacy of the Users of the Website and the services provided by Usthrough the Website. We (or Oursubcontractors) host the Website to connect Youto “HCPs” who have entered into agreements with Us. Once You,as a RegisteredHealthcare Seeker,selects one or more HCPs through the Website to avail Services to You, each of those HCPs may be referred to as “Your Provider” here forth.
We have written this Privacy Policy (“Privacy Policy”) to tell Youhow We collect, use, store, disclose and protect the information collected through the Services.
THE WEBSITE WILL BE COLLECTING, STORING AND SHARING PERSONAL, MEDICAL AND HEALTH-RELATED INFORMATION ABOUT YOU.
BY DOWNLOADING, ACCESSING, OR USING THE APPLICATION OR SERVICES, AND/OR BY REGISTERING WITH US OR PROVIDING INFORMATION TO US IN CONNECTION WITH THE APPLICATION, YOU ACCEPT THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY, AND YOU HEREBY CONSENT THAT WE WILL COLLECT, USE, AND SHARE YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. IF YOU ARE REGISTERING AN ACCOUNT OR USING THE SERVICES ON BEHALF OF AN INDIVIDUAL OR ENTITY OTHER THAN YOURSELF, YOU REPRESENT THAT YOU ARE AUTHORIZED BY SUCH INDIVIDUAL OR ENTITY TO ACCEPT THIS PRIVACY POLICY ON BEHALF OF SUCH INDIVIDUAL OR ENTITY.IF YOU DO NOT AGREE, PLEASE DO NOT USE THE WEBSITE.
Your use of the Application is also subject to our Terms & Conditions (GTC-V. 1.01.08)listed in a separate document and available on the website at www.growayu.com/term-condition.html. Apart from the definitions listed therein, certain additional definitions would be explained in respective sections below.

  • SOME DEFINITIONS

When We use the term “Personal Information” in this Privacy Policy, We mean information about You that is personally identifiable to You, such as Your contact information (e.g. name, telephone number, mobile number, E-Mail address, physical address, User ID etc.), demographic data (e.g. gender, date of birth, personally identifiable health or medical information that You choose to share with Us etc.), and any other non-public information that is associated with such information (collectively, “Personal Information”).
If You communicate with Us by, for example, E-Mail or letter, any information provided in such communication may be collected as Personal Information.In addition to the information that Wecollect directly from You, We may also collect certain Personal Information about You from or on behalf of Your Providers.
When Weuse the term “De-identified Information,” We mean information that is neither used nor intended to be used to personally identify an individual. Lastly, when Weuse the term “Cookies,” We mean the small pieces of information that the Website sends to Your browser while You are viewing the Website, which is intended to improve the user experience while using the Website.

  • INFORMATION THAT YOU PROVIDE TO US

We receive and store any information that You may knowingly or unknowingly share with Us. This can include

  • Your name, contact information, date of birth, age, gender, E-Mail address, username, password, and other registration information;
  • Health Information that You provide Us, which may include information on HCPs such as Registered Practitioners, nurses, diagnostic labs, pharmacy outlets etc. that You interacted with, Your reason for interacting with those HCPs, date of such interactions, description of symptoms, Your medical history and condition, any previous prescriptions or diagnoses, lifestyle descriptions, records relating to Your medical or health history, status of Your vital health parameters and laboratory testing results, diagnostic images, and other health related information;
  • Health information that You authorize third party service providers to provide to Us, such as for example, through a third party wearable device, third party health monitoring devices and applications, or through an external application that may support user communities;
  • Health information about You prepared by the HCPs who provide the Services through the Website such as medical records, treatment and examination notes, prescriptions, consultation summary, and other health related information;
  • Billing information that You provide Us, including physical billing address, any payment related informationetc;
  • Information about the computer or mobile device You are using, such as what Internet browser You use, the kind of computer or mobile device You use, location of Your mobile device, any third-party account credentials on Your mobile device that You may voluntarily share with Us, and other information about how You use the Website and application. In case You provide Your third-party account credentials to Us, You understand that some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into Your account with Us if You authorize such transmissions, and that such Third Party Account Information transmitted to our Services is covered by this Privacy Policy; and
  • Any other information You input into the Website or Application, or related services.
  • HOW WE USE THE INFORMATION YOU PROVIDE TO US

We and our third-party service providersmay use Your Personal Information to:

  • respond to Your inquiries and fulfilYour requests, such as to establish an interactionor engagement instance through text, chat, audio or video means, book an appointment for You with Your Provider, or;
  • send to You administrative information, including information regarding the Website/Application, and changes to Our terms, conditions and policies;
  • schedule and provide services related to the scheduling of Registered Practitioner consultation appointments; for example, to send to You appointment confirmation; communicate with You and Your Providers regarding Your health status, appointments and related services provided by Your Provider; obtain or facilitate payments for appointments and related services provided by Your Provider and send You payment receipts; and provide You with related customer service;
  • confirm that services You request were provided to You by Your Providers;
  • communicate with You about Your use of the Services;
  • send to You marketing communications that We believe may be of interest and help to You;
  • personalize Your experience on the Website/Application by presenting products and offers tailored to You;
  • allow You to send messages to a friend through the Website/Application (please note that, by using such functionality, You are agreeing that You have the right to provide to Us Your friend's name and e-mail address for such purpose;
  • to create De-identified Information such as aggregate statistics relating to the use of the Services;
  • further Our business purposes, such as quality assessment, data analysis, audits, developing new products, enhancing the Application, improving Our services, identifying usage trends, developing tools which help You assess the performance, competence and qualifications of healthcare professionals and conducting training programs for such professionals, and determining the effectiveness of our promotional campaigns;
  • act as We believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce Our Terms of Use; (e) to protect our operations or those of any of Our affiliates; (f) to protect Our rights, privacy, safety or property, or that of Our affiliates, You or others; (g) at Our discretion under emergency circumstances, to notify emergency services or Your family members, personal representative or other individuals involved in Your care of Your location and condition; or (h) to allow Us to pursue available remedies or limit the damages that We may sustain;

Also, Wemay receive a confirmation when You open a message from Us. This confirmation helps Usmake our communications with You more relevant and improve Our services. If You do not want to receive communications from Us that are not important to the Service, please indicate Your preference by clicking on the unsubscribe link provided at the bottom of each E-Mail sent to You by Us. Please note that if You do not want to receive legal information from Us and should You choose to unsubscribe regarding the same yet, those legal notices will still govern Your use of the Services, and You are responsible for reviewing such legal information for changes.
We may anonymize Your Personal Information so that You cannot be individually identified, and provide only such information to Our partners.In particular, the Company reserves with it the right to use anonymized User demographics information and anonymized User health information for the following purposes:

  • Analyzing software/Website usage patterns for improving product design and utility;
  • Analyzing such information for research and development of new technologies;
  • Using analysis of such information in other commercial product offerings of the Company;
  • Sharing analysis of such information with third parties for commercial use.

At times, Wemay conduct a User survey to collect information about Users’ preferences. These surveys are optional and if Users choose to respond, their responses will be kept anonymous. Similarly, Wemay offer contests to qualifying End-Users in which We ask for contact and demographic information such as name, E-Mail address and mailing address. The demographic information that Wecollect during the registration process and through surveys is used to help Us improve Our Services to meet the needs and preferences of Our Users.

  • UNDER WHAT CIRCUMSTANCES AND FOR WHAT PURPOSES THE INFORMATION YOU PROVIDE TO US MAY BE SHARED

Your Personal Information may be shared or disclosed:

  • to Our third-party service providers that provide services such as hosting of the Website/Application, data analysis, IT services and infrastructure, customer service, E-Mail delivery, auditing and other similar services;
  • to HCPs, including Your Providers, to schedule and fulfil appointments and provide healthcare services and confirmthe delivery of those services to You;
  • to Our affiliated companies, for the purposes described for Personal Information in this Privacy Policy, including marketing purposes relating to their products and services;
  • to third parties, to permit them to send marketing communications to You regarding Our products or services or the services of Your Providers;
  • to help in identifyingYou to anyone to whom You send messages through the Application;
  • for other treatment, payment or health care purposes of Your Provider;
  • to a third party for the purpose of sending You SMS, Email and other types of notifications, related to the Services availed by You;
  • to a third party for the purpose of booking diagnostic lab tests for You, based on Your request, or with Your consent, or based on YourProvider’s advice;
  • to a third party for the purpose of delivering You medical supplies, based on Your based on Your request, or with Your consent, or based on Your Provider’s advice;
  • to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceeding);
  • to a third party as We believe to be necessary or appropriate: (a) under applicable law; (b) to comply with legal process; (c) to respond to requests from public or government authorities; (d) to enforce the Terms of Use; (e) to protect Our operations or those of any of Our affiliates; (f) to protect our rights, privacy, safety or property, or that of Our affiliates, You or others; (g) at Our discretion under emergency circumstances, to notify emergency services or Your family members, personal representative or other individuals involved in Your care of Your location and condition; or (h) to allow Us to pursue available remedies or limit the damages that We may sustain;
  • when We believe in good faith that disclosure is necessary to protect Your safety or the safety of others, to protect Our rights, to investigate fraud, or to respond to a government request;
  • for any other purpose disclosed by Us when You provide the information;
  • to other Users to facilitate development of User communities and promote helpful interactions within the community regarding the Services provided or to address Your request for Company’s services. This includes certain User profile information, including without limitation a User’s name and location.Your account privacy settings would allow You to limit the other Users who can see the Personal Information in YourUser profile and/or what information in YourUser profile is visible to others when such a service is offered by Company in the future. Any content You upload to Your public user profile, along with any Personal Information or content that You voluntarily disclose online in a manner other Users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by others. Your user name may also be displayed to other Users if and when You send messages or comments or upload images or videos through the Services and other Users can contact You through messages and comments. Again, We do not control the policies and practices of any other third party site or service which may interact with Our Services;
  • to a third party person, entity or application that You may authorize Us to share;

Our disclosure of Your Personal Information may also be subject to certain restrictions set forth in an agreement between Usand Your Provider.

  • COMPANY EMPLOYEE AND AGENTS CONFIDENTIALITY

We follow a strict confidentiality clause with regards to disclosure of Personal Information to its Employees or other personnel. There may be situations, where Wemay disclose the confidential information only to those of our Employees and other personnel on a “need to know basis” and who agree to abide by the confidentiality obligations. Any breach of Personal Information by the Employees, personnel within Company is taken stringently by the Company and may result in appropriate disciplinary action, or termination, or initiation of legal actions on the defaulting person.
We also employ other companies and people to perform tasks on Ourbehalf and need to share Your information with them to provide products or services to You. Unless Wetell You differently, Our agents do not have any right to use the Personal Information We share with them beyond what is necessary to assist Us.

  • MODIFICATION OF INFORMATION YOU HAVE SHARED WITH US

As a User, You would be able to make changes to and update some of the information You have shared with Us through the Website or Application. Certain information that is used for verifying Your identity may not be modifiable without verification. In case You would need to modify any such non-modifiable information, request You to please write to [email protected].
You may be able to add, update, or delete information as explained above. When You update information, however, We may maintain a backup copy of the unrevised information in our records for legal purposes.

  • LIMITATION ON DELETION OF INFORMATION YOU HAVE SHARED WITH US

You may request deletion of Your Personal Information by Us, but please note that We may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case We will comply with Your deletion request only after We have fulfilled such requirements). When Wedelete Personal Information, it will be deleted from the active database, but may remain in Our archives and We may also retain Anonymous Information about Your use of Our Service. Once Wedisclose some of Your Personal Information to third parties, We may not be able to access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom We have made those disclosures. After Wedelete Personal Information, We will retain De-Identified Data and will continue to use De-Identified Data as permitted under this Privacy Policy.

  • INFORMATION THAT WE MAY COLLECT THROUGH TECHNOLOGY

When You use Our Website or Application, We continuously strive to improve Your experience and make it better and more meaningful. To help with this, certain information may be passively collected automatically through Technology. This information is largely Non-Personal or De-Identified information.
We or Our third party service providers may use cookies, navigational data like Uniform Resource Locators (URLs) and third party tracking services, including:

  • Site Activity Information:We may keep track of some of the actions You take on the Site, such as the content of searches You perform on the Site.
  • Access Device and Browser Information: When You access the Site from a computer or other device, We may collect anonymous information from that device, such as YourInternet protocol address, browser type, device type and model, connection speed and access times (collectively, “Anonymous Information”).

If You do not accept Cookies; however, You will not be able to stay logged in to the Website. We currently do not honor “Do Not Track” requests across all part of Our Website.
  • Web beacons (clear GIFs, web bugs):Web beacons are tiny graphics with a unique identifier, similar in function to cookies that are used to track the online movements of Web users. In contrast to cookies, which are stored on Your computer’s hard drive, Web beacons are embedded invisibly on webpages and may not be disabled or controlled through Your browser.They help to track site visitor activity and collect website data. We may combine this data with the Personal Information Wehave collected from users.
  • Real-Time Location: Certain features of the Website and Application use GPS technology to collect real-time information about the location of Your device so that they can connect You to a HCP who is licensed or authorized to provide services in the place where You are located.
  • Mobile Services:We may also collect non-personal information from Your mobile device or computer. This information is generally used to help Usdeliver the most relevant information to You. Examples of information that may be collected and used include how You use the application(s) and information about the type of device or computer You use. In addition, in the event our application(s) crashes on Your mobile device,We will receive information about Your mobile device model software version and device carrier, which would allowUs to identify and fix bugs and otherwise improve the performance of our application(s).
  • Unique device Identifier:When You download and install Our mobile application onto Your device, We may assign a number (a unique device identifier) to Your mobile application instance. This number cannot be used to identify You personally, and We cannot identify You personally unless You choose to become a Registered User. We use this number in a manner similar to Ouruse of cookies as described above. Unlike cookies, the number is assigned to Your installation of the Application itself and not a browser because the Application does not work through Your browser.
  • Third Parties:We may engage third parties to track and analyzethe mobile Application or Website activity on Ourbehalf. To do so, these third parties may place cookies or web beacons or such technologies to track user activity on Our Website. We use the data collected by such third parties to help Usadminister and improve the quality of the mobile application or Website and to analyze usage of the mobile application or Website. We never disclose aggregate information to a partner in a manner that would identify You personally.
  • HOW WE USE AND SHARE THE NON-PERSONAL OR DE-IDENTIFIED INFORMATION

We may use De-identified Information created by Uswithout restriction.Because Non-personal Information does not personally identify You, We may use, share and disclose Non-personal Information for any purpose. In some instances, Wemay combine Non-personal Information with Personal Information (such as combining YourPIN code with Your name, or with Your name together with a medical condition). If Wecombine any Non-personal Information with Personal Information, the combined information will be treated by Us as Personal Information as long as it is so combined.

  • YOUR CHOICES

You can opt not to disclose information to use, but keep in mind that some information may be needed to register with Usor to take advantage of some of the Website or Application features.
We give You choices regarding Our use and disclosure of Your Personal Information for marketing purposes. Specifically, You may opt-out from:

  • Receiving marketing-related E-Mails from Us based upon Your Personal Information: If You no longer want to receive marketing-related E-Mails from Us on a going-forward basis, You may opt-out of receiving such marketing related E-Mails by sending an E-Mail to [email protected].
  • Our sharing of Your Personal Information with Our affiliates for their marketing purposes:If You would prefer that We do not share Your Personal Information on a going-forward basis with Our affiliates for their marketing purposes, You may opt-out of such sharing by sending an E-Mail to [email protected].

We will try to comply with Your request(s) as soon as reasonably practicable. Please note that if You opt-out as described above, We will not be able to remove Your Personal Information from the databases of our affiliates with which We have already shared such information (i.e., to which We have already provided such information as of the date that We implement Your opt-out request). Please also note that if You do opt-out of receiving marketing-related messages from Us, We may still send transactional and administrative messages to You; You cannot opt-out from receiving transactional and administrative messages.

  • HOW WE STORE AND PROTECT YOUR INFORMATION

Your Personal Information is maintained by Usin electronic form. From time to time, some such information may also be converted to physical form. We shall take all necessary precautions to protect Your personal information both online and off-line, and implement reasonable security practices and measures including certain operational, technical, administrative and physical security control measures that are commensurate with respect to the information being collected and the nature of Our business.
None of Our administrator will have knowledge of Your password. It is important for You to protect against unauthorized access to Your password, Your computer and Your mobile phone. Be sure to log off from the Website/ Application when You are through with the purpose for which You logged into it. We do not undertake any liability for any unauthorized use of Your account and password. If You suspect any unauthorized use of Your account, You must immediately notify Us by sending an email to [email protected]. You shall be liable to indemnify Usdue to any loss suffered by it due to such unauthorized use of Your account and password.
We make the User information accessible to Ouremployees, agents or partners and third parties only on a “need-to-know basis,” and bind our employees to strict confidentiality obligations.
With regards to data transmission over the Internet or data storage facility, please be aware that unfortunately, no data transmission over the Internet or data storage system is 100% secure, and therefore,Wecannot guarantee against all potential security breaches.As a result, while Wetry to protect Your Personal Information, We cannot ensure or guarantee the security of any information You transmit to us, and You do so at Your own risk.
The Company is not responsible for the confidentiality, security or distribution of Your Personal Information by our partners and third parties outside the scope of Ouragreement with such partners and third parties. Further, We shall not be responsible for any breach of security or for any actions of any third parties or events that are beyond the reasonable control of Company including but not limited to, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, poor quality of Internet service or telephone service of the User etc.

  • NON-REGISTERED USERS OR CASUAL VISITORS

“Non-Registered Users” usually denote Users who merely visit the Website without opting to get registered with the Website, and hence having restricted or very limited access to the information on the Website (as defined under Clause 1.2 of GTC 1.01.8. No sensitive personal data or information is automatically collected by Usfrom any such Non-Registered Users or casual visitors of the Website or Application.
Nevertheless, certain provisions of this Privacy Policy are applicable to even such Non-Registered Users, and they are also required to read and understand the privacy statements set out herein, failing which they are required to leave the Website immediately.
If You, as a Non-Registered User, have inadvertently browsed any other page of the Website prior to reading the privacy statements set out herein, and You do not agree with the manner in which such information is obtained, collected, processed, stored, used, disclosed or retained, merely quitting the browser application or deletion of the Application from the mobile device, should ordinarily clear all temporary cookies installed by Company. All visitors, however, are encouraged to use the “clear cookies” functionality of their browsers and/or should clear cache in the mobile devices running the Application, to ensure such clearing / deletion, as Wecannot guarantee, predict or provide for the behaviour of the equipment of all the visitors of the Website.
You are not a Non-Registered User or a casual visitor if You have willingly submitted any personal data or information to Us through any means, including E-Mail, post or through the registration process on the Website. All such visitors will be deemed to be, and will be treated as Users for the purposes of this Privacy Policy, and in which case, all the statements in this Privacy Policy apply to such persons.

  • USE OF APPLICATION BY MINORS

The Website and Application are not intendedfor individuals under the age of 18, and Wedo not knowingly collect Personal Information from individuals under the age of 18. If We learn that We have received any information from an individual under the age of 18, We will use that information only to respond directly to that minor child,or to his/her parent, legal guardian or personal representative, to inform that the minor child cannot use the Services and subsequently We will delete that information from Our own servers. However, if You are a parent, legal guardian or personal representative of a minor child, You may, in compliance with the Terms and Conditions (GTC-V 1.01.08), use the Services on behalf of such minor child. Any information that You provide Us while using the Services on behalf of Your minor child will be treated as Personal Information as otherwise provided herein.

  • SERVICE GUARANTEE

Company and the HCP takes no responsibility if specific request (including but not limited to appointment request, or any request requiring third party services, etc.) from You is not received by the HCP or is delayed due to network congestion, technical disruption, network failure or any other reason. Same is the scenario if certain specific information sent (including but not limited to notifications, advice, comments, chats, etc.) to You is not received by You or is delayed due to network congestion, technical disruption, network failure or any other reason.
Company collects and manages personal information obtained through this registration in accordance with Our Privacy Policy. We endeavour to provide a functional and convenient Service, but Wedo not guarantee that Your web browser, or mobile device will be compatible with Our Website or the Application or that any content will be uninterrupted or error free. Company is not responsible for any interruption in service due to, but not limited to, changes or updates in individual clinic’s practice, network failure, or any other technical incident, not related to the Company. We reserve the right to change the terms and conditions of use of the Service without any prior written notification.

  • THIRD PARTIES

This Privacy Policy applies only to information Wecollect through the Website and Application, and in E-Mail, text and other electronic communications set through or in connection with the Website and Application. This Privacy Policy does not address, and We are not responsible for, the privacy, information or other practices of any third parties, including HCPs, the manufacturer of Your mobile device, and any other third party mobile application or website to which the Application may contain a link. We encourage You to review the Notice of Privacy Practices of each Provider who provides You with services and the privacy policies of each website and application You visit and use.

  • JURISDICTIONAL ASPECTS

This Policy, and Our collection, use, and disclosure of Your Personal Information (as defined below) shall be governed by and shall be construed in accordance with Indian law..We do not represent or warrant that the Website/Application, or any functionality or feature thereof, is appropriate or available for use in any particular jurisdiction. If You choose to access or use the Application from outside the country, You do so on Your own initiative and at Your own risk, and are responsible for complying with relevant local laws, rules and regulations. By using the Website/Application and submitting any Personal Information from outside India, You acknowledge that the Website is subject to Indian regulations and consent to the transfer of Your Personal Information to India, which may provide a different level of data security than in Your country of residence.

  • CHANGES TO PRIVACY POLICY

GrowAyu Technologies may make changes or updates to this Privacy Policy at any time and any such changes to this Privacy Policy will become effective when the revised Privacy Policy becomes available through the Website/Application. The “Last Revised” date would be included at the beginning of this Privacy Policy if any such changes are made to this Privacy Policy. Your use of the Website/Application or the submission of any information in connection with the Website/Application following any change means that You accept the revised Privacy Policy.

  • CONTACTING US
