At GrowAyu Technologies Private Limited (for short, “GrowAyu”), We know that while You use Our website, application or services, You may share Your personal information with Us. 1.INTRODUCTIONGrowAyu is the sole author and publisher of the Internet resource www.growayu.com and the mobile application “GrowAyu” (either together or separately for short, the “Website”).
GrowAyu owns and operates the services provided through the Website and mobile
application, which operates under the brand name “GrowAyu.”
The terms such as “You,” “Your” and “Yours” generally refer to You as the User (as defined
under Clause 1.6 of GTC-V.3.01) and the terms such as “GrowAyu,” “We,” “Us,” “Company” and
“Our” generally refer to GrowAyu.
The terms, “Registered Healthcare Seeker,” “Healthcare Provider” or “HCP,” “Non-Registered
User,” “Registered User,” Registered Practitioner” and “User” have the same meaning as are
defined respectively under Clause 1 of GTC-V. 3.01.
GrowAyu is committed to respect the privacy of the Users of the Website and the services
provided by Us through the Website. We (or Our subcontractors) host the Website to connect
You to “HCPs” who have entered into agreements with Us. Once You, as a Registered
Healthcare Seeker, selects one or more HCPs through the Website to avail Services to You, each of those HCPs may be referred to as “Your Provider” here forth.
We have written this Privacy Policy (“Privacy Policy”) to tell You how We collect, use, store,disclose and protect the information collected through the Services.

BY DOWNLOADING, ACCESSING, OR USING THE APPLICATION OR SERVICES, AND/OR BY
REGISTERING WITH US OR PROVIDING INFORMATION TO US IN CONNECTION WITH THE
APPLICATION, YOU ACCEPT THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY,

Apart from the definitions listed therein, certain additional definitions would be explained in respective sections below.
When We use the term “Personal Information” in this Privacy Policy, We mean information
about You that is personally identifiable to You, such as Your contact information (e.g. name,telephone number, mobile number, E-Mail address, physical address, User ID etc.),
demographic data (e.g. gender, date of birth, personally identifiable health or medical
information that You choose to share with Us etc.), and any other non-public information that is associated with such information (collectively, “Personal Information”).
If You communicate with Us by, for example, E-Mail or letter, any information provided in such communication may be collected as Personal Information. In addition to the information that We collect directly from You, We may also collect certain Personal Information about You from or on behalf of Your Providers.
When We use the term “De-identified Information,” We mean information that is neither used
nor intended to be used to personally identify an individual. Lastly, when We use the term
“Cookies,” We mean the small pieces of information that the Website sends to Your browser
while You are viewing the Website, which is intended to improve the user experience while
using the Website.
We receive and store any information that You may knowingly or unknowingly share with Us.

We follow a strict confidentiality clause with regards to disclosure of Personal Information to its Employees or other personnel. Any breach of Personal Information by the Employees, personnel within Company is taken stringently by the Company and may result in appropriate disciplinary action, or termination, or initiation of legal actions on the defaulting person.

share Your information with them to provide products or services to You. Unless We tell You
differently, Our agents do not have any right to use the Personal Information We share with
them beyond what is necessary to assist Us.
As a User, You would be able to make changes to and update some of the information You
have shared with Us through the Website or Application. Certain information that is used for
verifying Your identity may not be modifiable without verification. In case You would need to modify any such non-modifiable information, request You to please write to

You may be able to add, update, or delete information as explained above. When You update
information, however, We may maintain a backup copy of the unrevised information in our
records for legal purposes.
You may request deletion of Your Personal Information by Us, through the provision provided in the GrowAyu app. Please note that We may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case We will comply with Your deletion request only after We have fulfilled such requirements). When We delete Personal Information, it will be deleted from the active database, but may remain in Our archives and We may also retain Anonymous Information about Your use of Our Service. Once We disclose some of Your Personal Information to third parties, We may not be able to access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom We have made those disclosures. After We delete Personal Information, We will retain De-Identified Data and will continue to use De-Identified Data as permitted under this Privacy Policy.
9. INFORMATION THAT WE MAY COLLECT THROUGH TECHNOLOGY
When You use Our Website or Application, We continuously strive to improve Your experience
and make it better and more meaningful. To help with this, certain information may be
passively collected automatically through Technology. This information is largely Non-Personal or De-Identified information.
We or Our third party service providers may use cookies, navigational data like Uniform
Resource Locators (URLs) and third party tracking services, including:
We may use De-identified Information created by Us without restriction. Because Non-personal Information does not personally identify You, We may use, share and disclose Non-personal Information for any purpose. In some instances, We may combine Non-personal Information with Personal Information (such as combining Your PIN code with Your name, or with Your name together with a medical condition). If We combine any Non-personal Information with Personal Information, the combined information will be treated by Us as Personal Information as long as it is so combined.
11. YOUR CHOICES
You can opt not to disclose information to use, but keep in mind that some information may
be needed to register with Us or to take advantage of some of the Website or Application
features.
We give You choices regarding Our use and disclosure of Your Personal Information for

Your Personal Information is maintained by Us in electronic form. From time to time, some
such information may also be converted to physical form. We shall take all necessary
precautions to protect Your personal information both online and off-line, and implement

administrative and physical security control measures that are commensurate with respect to
the information being collected and the nature of Our business.
None of Our administrator will have knowledge of Your password. It is important for You to
protect against unauthorized access to Your password, Your computer and Your mobile
phone. Be sure to log off from the Website/ Application when You are through with the
purpose for which You logged into it. We do not undertake any liability for any unauthorized
use of Your account and password. If You suspect any unauthorized use of Your account, You
must immediately notify Us by sending an email to [email protected]. You shall be liable
to indemnify Us due to any loss suffered by it due to such unauthorized use of Your account
and password.
We make the User information accessible to Our employees, agents or partners and third
parties only on a “need-to-know basis,” and bind our employees to strict confidentiality
obligations.
With regards to data transmission over the Internet or data storage facility, please be aware that unfortunately, no data transmission over the Internet or data storage system is 100% secure, and therefore, We cannot guarantee against all potential security breaches. As a result, while We try to protect Your Personal Information, We cannot ensure or guarantee the security of any information You transmit to us, and You do so at Your own risk.
The Company is not responsible for the confidentiality, security or distribution of Your
Personal Information by our partners and third parties outside the scope of Our agreement
with such partners and third parties. Further, We shall not be responsible for any breach of
security or for any actions of any third parties or events that are beyond the reasonable
control of Company including but not limited to, acts of government, computer hacking,
unauthorized access to computer data and storage device, computer crashes, breach of
security and encryption, poor quality of Internet service or telephone service of the User etc.
“Non-Registered Users” usually denote Users who merely visit the Website without opting to
get registered with the Website, and hence having restricted or very limited access to the
information on the Website (as defined under Clause 1.2 of GTC 3.01. No sensitive personal
data or information is automatically collected by Us from any such Non-Registered Users or
casual visitors of the Website or Application.
Nevertheless, certain provisions of this Privacy Policy are applicable to even such Non-
Registered Users, and they are also required to read and understand the privacy statements
set out herein, failing which they are required to leave the Website immediately.
If You, as a Non-Registered User, have inadvertently browsed any other page of the Website
prior to reading the privacy statements set out herein, and You do not agree with the manner
in which such information is obtained, collected, processed, stored, used, disclosed or
retained, merely quitting the browser application or deletion of the Application from the
mobile device, should ordinarily clear all temporary cookies installed by Company. All visitors, however, are encouraged to use the “clear cookies” functionality of their browsers and/or should clear cache in the mobile devices running the Application, to ensure such clearing / deletion, as We cannot guarantee, predict or provide for the behaviour of the equipment of all the visitors of the Website.
You are not a Non-Registered User or a casual visitor if You have willingly submitted any
personal data or information to Us through any means, including E-Mail, post or through the
registration process on the Website. All such visitors will be deemed to be, and will be treated as Users for the purposes of this Privacy Policy, and in which case, all the statements in this Privacy Policy apply to such persons.
The Website and Application are not intended for individuals under the age of 18, and We do not knowingly collect Personal Information from individuals under the age of 18. If We learn that We have received any information from an individual under the age of 18, We will use that information only to respond directly to that minor child, or to his/her parent, legal guardian or personal representative, to inform that the minor child cannot use the Services and subsequently We will delete that information from Our own servers. However, if You are a parent, legal guardian or personal representative of a minor child, You may, in compliance with the Terms and Conditions (GTC-V 3.01), use the Services on behalf of such minor child. Any information that You provide Us while using the Services on behalf of Your minor child will be treated as Personal Information as otherwise provided herein.
15. SERVICE GUARANTEE
Company and the HCP takes no responsibility if specific request (including but not limited to appointment request, or any request requiring third party services, etc.) from You is not received by the HCP or is delayed due to network congestion, technical disruption, network failure or any other reason. Same is the scenario if certain specific information sent (including but not limited to notifications, advice, comments, chats, etc.) to You is not received by You or is delayed due to network congestion, technical disruption, network failure or any other reason.
Company collects and manages personal information obtained through this registration in
accordance with Our Privacy Policy. We endeavour to provide a functional and convenient
Service, but We do not guarantee that Your web browser, or mobile device will be compatible
with Our Website or the Application or that any content will be uninterrupted or error free.
Company is not responsible for any interruption in service due to, but not limited to, changes or updates in individual clinic’s practice, network failure, or any other technical incident, not related to the Company. We reserve the right to change the terms and conditions of use of the Service without any prior written notification.
This Privacy Policy applies only to information We collect through the Website and Application, and in E-Mail, text and other electronic communications set through or in connection with the Website and Application. This Privacy Policy does not address, and We are not responsible for, the privacy, information or other practices of any third parties, including HCPs, the manufacturer of Your mobile device, and any other third party mobile application or website to which the Application may contain a link. We encourage You to review the Notice of Privacy Practices of each Provider who provides You with services and the privacy policies of each website and application You visit and use.

JURISDICTIONAL ASPECTSThis Policy, and Our collection, use, and disclosure of Your Personal Information (as defined below) shall be governed by and shall be construed in accordance with Indian law.. We do not represent or warrant that the Website/Application, or any functionality or feature thereof, is appropriate or available for use in any particular jurisdiction. If You choose to access or use the Application from outside the country, You do so on Your own initiative and at Your own risk, and are responsible for complying with relevant local laws, rules and regulations. By using the Website/Application and submitting any Personal Information from outside India, You acknowledge that the Website is subject to Indian regulations and consent to the transfer ofYour Personal Information to India, which may provide a different level of data security than in Your country of residence.

CHANGES TO PRIVACY POLICYGrowAyu Technologies may make changes or updates to this Privacy Policy at any time and anysuch changes to this Privacy Policy will become effective when the revised Privacy Policy becomes available through the Website/Application. The “Last Revised” date would be included at the beginning of this Privacy Policy if any such changes are made to this Privacy Policy. Your use of the Website/Application or the submission of any information in connection with the Website/Application following any change means that You accept the revised Privacy Policy.
